1. Acceptance of Terms

By creating an account or using the Lumio mobile application or website (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service. The Service is operated by ODBS Tech ("Lumio", "we", "our", or "us").

2. Description of Service

Lumio is an AI skincare application that analyzes a selfie to estimate skin characteristics, generates a personalized skincare routine, offers an in-app coaching assistant ("Aria"), and helps you track skincare habits and progress. Lumio provides cosmetic and wellness information only.

3. Not Medical Advice

Lumio is not a medical device and does not provide medical advice, diagnosis, or treatment. Skin analysis results are estimates generated by software and may be inaccurate. Aria is an automated assistant, not a healthcare professional. Always seek the advice of a qualified dermatologist or physician for any medical concern, and never disregard professional medical advice because of something you read or received in the Service. If you think you have a medical emergency, contact your local emergency services.

4. Eligibility, Account & Acceptable Use

You must be at least 13 years old (or the minimum age in your country) to use the Service. You are responsible for safeguarding your account credentials and for all activity under your account. You agree not to:

• Upload photos of anyone other than yourself without their consent, or upload content that is illegal, infringing, or abusive.
• Use the Service to provide medical, diagnostic, or treatment services to others.
• Reverse engineer, scrape, or interfere with the Service, attempt to bypass rate limits, or access another user's account.
• Misuse the Aria assistant to generate harmful, unlawful, or abusive content.
• Upload malicious code or attempt to compromise the security or integrity of the Service.
• Use the Service in violation of any applicable law or the policies of the Apple App Store or Google Play.

5. Your Content & Photos

You retain ownership of the selfies and content you submit. You grant us a limited license to process your photos and content solely to operate the Service — to analyze your skin, generate routines, and power Aria. Selfies are deleted within 24 hours of analysis as described in our Privacy Policy, and no biometric template is created.

6. Subscriptions & Billing

Lumio offers a free tier and a paid "Lumio Pro" subscription sold as an in-app purchase through Apple's App Store and Google Play. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period, in line with app store policies. Subscription validation and entitlements are handled by RevenueCat. To manage or cancel a subscription, use your App Store or Google Play account settings. Refunds are governed by Apple's and Google's policies and applicable law.

7. AI-Generated Content

Skin analyses, routines, and Aria responses are generated automatically and may contain errors or omissions. They are provided for general informational and cosmetic purposes only, without warranty of accuracy. You are responsible for how you use any recommendation, and you should patch test new products and discontinue anything that irritates your skin.

8. Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, error-free analysis, or that the Service will meet your expectations. Features may change or be discontinued over time.

9. Intellectual Property

The Service, including its software, design, content, and the Lumio and Aria names and logos, is owned by ODBS Tech and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or content except as necessary to use the Service.

10. Privacy

Our handling of your data is governed by our Privacy Policy, which forms part of these Terms.

11. Termination

You may terminate your account at any time by deleting it from inside the app or via the Account Deletion page. We may suspend or terminate your account if you violate these Terms or any applicable law, or if your continued use places Lumio or its providers at risk.

12. Limitation of Liability

To the maximum extent permitted by law, Lumio and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Service, including reliance on any analysis or recommendation. Our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months preceding the claim.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or via email. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after a change becomes effective constitutes acceptance.

14. Governing Law & Contact

These Terms are governed by the laws of Türkiye, without regard to its conflict-of-law principles, and any dispute will be brought before the competent courts of Istanbul unless mandatory consumer protection law in your country gives you a different forum.
